General Terms and Conditions for Purchases in the natural online store of Azadivine GmbH

  1. Scope of application
  • These General Terms and Conditions (hereinafter referred to as "GTC") apply in their current version at the time of the order for all orders in the natüür online store for the delivery of the products offered there by us.

  • We are Azadivine GmbH, Maximilianstraße 40, 80539 Munich (Munich Local Court, HRB 247989) (hereinafter referred to as "Azadivine") and can be contacted by telephone on +49 (0) 89 189426-200, Monday to Friday from 9:00 to 18:00, or by e-mail at support@natuur.de.

  • The natüür online store is aimed at consumers within the meaning of § 13 BGB (hereinafter referred to as "customer"). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. Indications of this are, for example, orders of more than normal household quantities.

  • The contractual relationship between the parties is fully described by these General Terms and Conditions and the order confirmation from Azadivine. There are no supplementary or deviating provisions or ancillary provisions. Should supplementary or deviating provisions be made at a later date, they must be in text form to be effective. Individual contractual agreements shall take precedence over the General Terms and Conditions.

  • The offers in the natüür online store are aimed at customers in Germany, but are made available to customers resident in the EEA under the same conditions due to the EU Geoblocking Regulation (Regulation (EU) 2018/302). The same applies to customers with a place of residence or business in Switzerland.



    2. Ordering
  • The presentation of our products in the natüür online store constitutes a binding offer in the legal sense. With your order you accept our offer to conclude a contract and a contract with us is concluded with your order.

  • In our natüür online store you can take a closer look at the desired product without obligation by clicking on the product. All available products can be added to your own shopping cart by clicking on the "Add to cart" button.

You can view the contents of the shopping cart at any time without obligation by clicking on the shopping cart graphic in the shopping cart window that opens. You can change the products and/or remove them from the shopping cart by adjusting the quantity and/or the "Remove" graphic.

As soon as the customer has decided to purchase the products in the shopping cart, the order process can be started by clicking on the "Check out" button in the shopping cart.

  • After entering your contact information, you can select the shipping options by clicking the "Continue to shipping" button. After clicking the "Continue to payment" button, you will reach the next step of the order process and can select the desired payment method. In the last step, you will receive an overview of your order data under "Check order" and can check your details again. You can correct input errors by using the button provided to return to previous order steps, navigate backwards in the browser or cancel the order process and start again. On the "Check order" subpage, you will be referred to our general terms and conditions and the declaration of revocation - you can also call up both texts there. To complete your purchase, you must click on the "Buy now" button. This sends the binding order to us. From this point on, it is unfortunately no longer possible to change the order or data. You also have the option of printing out both the order and the General Terms and Conditions before sending the order to us.

  • We will send you an order confirmation with all order data and the entire contract text by e-mail.

  • There is no minimum order value for orders in the natüür online store.

  • Only the German language is available for the conclusion of the contract.

 

3. Storage

The order data will be stored by us until the order has been fully processed (including for processing customer inquiries about the order) and then archived for storage in accordance with tax and commercial law.

The processing of personal data is governed by our privacy policy, which you can access at https://natuur.de/policies/privacy-policy.

 

4. Prices and terms of payment

  • All prices in the natüür online store include statutory VAT. Any additional delivery and shipping costs will be indicated separately when ordering. We deliver with DHL or another provider of our choice. The price stated in the order is decisive.

  • For deliveries to countries outside the European Union, additional costs may be incurred for which the seller is not responsible and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also be incurred in relation to the transfer of funds if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
  • Various payment options are available to the customer in the natüür online store. For each order, we reserve the right not to offer certain payment options and to refer to other payment options.

To pay with certain payment methods, such as ApplePay, Amazon Pay, Google Pay or ShopPay, you must be registered with the respective provider or register. After you have entered your access data for your account on the provider's website, you must confirm the payment instruction to us using the payment method provided. Finally, you will be redirected back to our store where you can complete the order process. Payment will be made immediately after placing the order.

In the case of payment by credit card, the credit card will be charged immediately after the order has been placed and you have been legitimized as the legitimate credit card holder. 

We offer the payment option purchase on account in cooperation with Klarna (www.klarna.com). The prerequisite for payment on account with Klarna is consent to the transmission of the data required for invoice processing and an identity and credit check to Klarna. If the result of the credit check is positive, we assign our claim against the customer to Klarna. When paying on account with Klarna, the Klarna conditions apply. The invoice amount must be paid within thirty days of the goods being dispatched to the account sent by Klarna by e-mail. The payment information will be sent separately by Klarna by e-mail. Payments to our bank account will not be forwarded but transferred back.

  • We remain the owner of the delivered products until full payment has been made.



    5. Terms of delivery
  • The delivery area includes the Federal Republic of Germany and Austria.

  • Unless a different delivery period is specified in the respective offer, the goods will be delivered within 2 - 4 working days in Germany and within 3 - 5 working days for deliveries abroad. The delivery period for orders placed before 12:00 noon begins on the day the order is placed and otherwise on the following day.
  • If you have ordered products with different delivery times, we will send them together in one shipment, unless we have made a different agreement with you. In this case, the delivery time is determined by the product with the longest delivery time that you have ordered.

6. Right of withdrawal

Consumers have a right of withdrawal in accordance with the withdrawal policy, which you can access at the following link: https://natuur.de/policies/refund-policy. The revocation of your contract can be made verbally, by telephone or in text form.

If you return the products to us within the withdrawal period without giving reasons, we will treat this as an exercise of your right of withdrawal.

 

7. Warranty

  • The customer is entitled to the statutory warranty rights with regard to the products offered in the natüür online store.

  • The product to be supplied by Azadivine is free from material defects if it has the agreed quality at the time of transfer of risk. Compliance with the specifications in the product description is agreed as the quality. Risks of suitability, use or application are the responsibility of the customer and do not constitute a defect.

  • In the event of a warranty claim, please contact us using the contact details given in Section 9.

  • It is the customer's responsibility to notify us of defects in a comprehensible and detailed form, stating the information useful for identifying the defect. The description of the defect must be sufficiently detailed to enable Azadivine to precisely identify and trace it.

8. Liability for damages and reimbursement of expenses

We are liable for damages in accordance with the statutory provisions.

11. Dispute resolution

We endeavor to find an amicable solution to any differences of opinion with our customers. To clarify any questions, please contact our customer service (section 9).

In accordance with EU Regulation No. 524/2013, the EU Commission has provided an interactive website for the online dispute resolution platform (ODR platform) for the settlement of out-of-court disputes arising from online legal transactions. Azadivine declares its willingness to participate in consumer arbitration proceedings under the Consumer Dispute Resolution Act in the event of legal conflicts with consumers.
